Community Guidelines & Additional Terms

GameSpotr is licensed to you under Apple’s Standard License Agreement (EULA). These Community Guidelines & Additional Terms (“Terms”) are between you and David Whitt (“GameSpotr,” “we,” “us”) and add rules for the community features of the app, which Apple’s EULA does not cover. By creating an account or using GameSpotr you agree to the Apple EULA, these Terms and our Privacy Policy. If you do not agree, do not use the app.

1. Eligibility and your account

You must be at least 13 years old to use GameSpotr, and old enough to enter this agreement where you live. Some venues listed in GameSpotr are for adults 21 and over only; it is your responsibility to follow the age rules and laws that apply to you. You sign in with Apple or Google and are responsible for activity on your account. Tell us promptly if you believe your account has been compromised.

2. Community standards — no objectionable content

There is no tolerance for objectionable content or abusive users. You agree not to post, upload or submit anything that:

• is hateful, harassing, threatening, bullying or discriminatory, or targets a person or group;
• is sexually explicit, graphic or violent, or promotes illegal activity or irresponsible or underage drinking;
• is false, misleading, spam, advertising, or a review you were paid or incentivized to write, or a review of a venue you have no experience with;
• contains personal information about others, or infringes anyone’s intellectual-property, privacy or other rights;
• impersonates another person or business, or uses a display name that is offensive;
• manipulates check-ins, XP, ratings or the leaderboard, including by faking your location; or
• interferes with, scrapes, reverse-engineers or attempts to gain unauthorized access to the app or its systems.

3. Your content

You keep ownership of the reviews, ratings, spot listings, tags and other content you submit (“Your Content”). You give GameSpotr a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt and distribute Your Content in and in connection with the app and its promotion. You promise that you have the rights to do so and that Your Content follows these Terms. Reviews and contributions are public to other signed-in users and are shown with your display name. The app’s name, logo and design belong to us, and the license to use the app itself is set out in Apple’s EULA.

4. Reporting and moderation

You can report a review in the app using Report Review; the review is hidden and sent to a moderator for review. You can also report any content or behavior by emailing davidwhitt@brotherwanderer.com. We may use automated tools and human moderators to review content. We may remove or edit content, or restrict, suspend or ban accounts, at our discretion and without notice, when we believe these Terms have been violated or to protect the community. We are not obligated to monitor content and do not guarantee that all objectionable content will be removed.

5. Venue information

Information about venues — including games, amenities, hours, age requirements, ratings, photos and reviews — is contributed by users or provided by third parties (such as Google Places). It may be inaccurate, incomplete or out of date, and venues may change or close. Confirm details with the venue before you go. GameSpotr is not affiliated with, endorsed by or sponsored by any listed venue, unless stated. GameSpotr does not sell or serve alcohol and does not promote excessive drinking; please drink responsibly, never drink and drive, and follow all local laws.

6. Location and check-ins

Some features use your device’s location, as described in the Privacy Policy. Check-ins require you to be physically near a spot. Use GameSpotr safely and be aware of your surroundings; do not use the app while driving.

7. Notifications

If you allow notifications, we may send messages about the app or nearby spots. You can turn them off at any time in iOS Settings.

8. Ending your use

You can stop using GameSpotr at any time and can delete your account in the app (Profile → Delete Account). Your account is deactivated immediately and permanently deleted after 30 days; logging in again within 30 days re-activates it. We may suspend or terminate your access at any time if you violate these Terms. Sections that by their nature should survive termination will survive.

9. Disclaimers

GameSpotr is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, secure or error-free. We are not responsible for the conduct of other users or venues, or for content posted by users or third parties.

10. Limitation of liability

To the fullest extent permitted by law, GameSpotr and its owner will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed US $50. Some places do not allow these limits, so they may not apply to you.

11. Changes

We may update these Terms from time to time. We will post the updated version here and change the date above. Continuing to use GameSpotr after changes means you accept them.
